1. Acceptance of Terms
By downloading, installing, or using GameWager ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.
2. Description of Service
GameWager is a real-time baseball prediction app that lets you make pitch-by-pitch predictions during live games and compete with friends. The App allows you to:
- Make real-time predictions on at-bat outcomes, pitch results, and inning scores during live baseball games
- Wager virtual GW Marks on predictions with dynamic multipliers
- Compete on per-game, following, and global season leaderboards
- Create and manage teams with invite codes, rosters, and team chat
- Follow other users, send direct messages, and view public profiles
- Score live youth baseball games using the built-in scorer tool (admin feature)
- Earn GW Marks through daily login bonuses and rewarded video ads
- Track prediction streaks and unlock achievements
3. No Real-Money Gambling
Important: GameWager is for entertainment purposes only. No real money, cryptocurrency, or anything of monetary value is wagered, exchanged, or transacted through this App. All GW Marks are virtual currency with no cash value and cannot be redeemed, transferred, or exchanged for real currency or goods. GameWager does not facilitate, encourage, or enable real-money gambling in any form.
4. Virtual Currency (GW Marks)
GW Marks are virtual tokens used solely within the App for making predictions. GW Marks:
- Have no real-world monetary value
- Cannot be purchased with real money
- Cannot be redeemed, cashed out, or transferred outside the App
- Are earned through correct predictions, daily login bonuses, watching rewarded ads, and claiming achievements
- May be lost through incorrect predictions
- Are non-transferable between users
5. User Accounts
You may create an account using Sign in with Apple, Google Sign-In, or email and password. You may also use the App in a limited Guest mode. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.
6. Age Requirements
The App is intended for users who are 13 years of age or older. By using this App, you confirm that you are at least 13 years old. Users under 18 should have parental consent before using the App.
7. User Roles
The App has two user roles:
- Fan: Can make predictions, view leaderboards, follow users, join teams, and participate in chat.
- Admin: In addition to fan capabilities, admins can create teams, manage rosters, create and score live games using the built-in scorer. By becoming an admin, you accept additional responsibility for accurate game scoring and team management.
8. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or real-money gambling
- Attempt to gain unauthorized access to the App or its systems
- Interfere with or disrupt the App's functionality
- Create multiple accounts to manipulate leaderboards or earn extra rewards
- Use automated tools, bots, or scripts to interact with the App
- Harass, abuse, or send harmful content to other users via chat or direct messages
- Intentionally enter inaccurate game scores as a scorer
- Exploit bugs or vulnerabilities to gain unfair advantages
9. Chat and User Content
The App provides game chat, team chat, and direct messaging features. You are solely responsible for the content of your messages. Messages are limited to 280 characters. We reserve the right to remove content and suspend accounts that violate these terms or engage in abusive behavior.
10. Advertisements
The App offers optional rewarded video ads through Google AdMob. Watching ads is entirely voluntary and rewards users with bonus GW Marks. Ad availability and content are managed by Google. We are not responsible for the content of third-party advertisements.
11. Intellectual Property
All content, features, and functionality of the App, including but not limited to text, graphics, logos, and software, are owned by GameWager and are protected by copyright, trademark, and other intellectual property laws.
12. Third-Party Services
The App integrates with third-party services including:
- Supabase (authentication and database storage)
- Google AdMob (rewarded video advertisements)
- Apple and Google identity providers (sign-in services)
Your use of these services is subject to their respective terms and privacy policies.
13. Data and Privacy
Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection and use of information as described in our Privacy Policy.
14. Account Termination
You may delete your account at any time through the App settings. Upon deletion, all your data, including GW Marks, predictions, achievements, and social connections, will be permanently removed from our systems. We reserve the right to suspend or terminate accounts that violate these terms.
15. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. GAME SCORES AND REAL-TIME DATA MAY NOT ALWAYS BE ACCURATE OR UP TO DATE. PREDICTION OUTCOMES ARE DETERMINED BASED ON SCORED GAME DATA AND MAY BE SUBJECT TO SCORING ERRORS.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GAMEWAGER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF VIRTUAL CURRENCY (GW MARKS) DUE TO TECHNICAL ISSUES.
17. Changes to Terms
We reserve the right to modify these Terms of Service at any time. We will notify users of significant changes through the App. Your continued use of the App after such modifications constitutes acceptance of the updated terms.
18. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
